South Carolina Vape Tax Starts Oct. 1: Register Sept 24

South Carolina begins collecting a new Nicotine Vapor Products Tax on October 1, 2026. The South Carolina Department of Revenue (SCDOR) opens registration for the tax on September 24, and the first return - covering the October period - is due November 20, 2026. For e-liquid brands, distributors and wholesale buyers moving product into the Palmetto State, the compliance clock is measured in days, not months.

The tax was created by Act 234 (H. 4303), signed into law earlier this year. Until now, South Carolina applied only ordinary sales tax to vapor products. That changes at the start of next month.

What the Nicotine Vapor Products Tax Covers

Per SCDOR, the tax applies to vapor products, electronic cigarettes and e-liquids that contain any form of consumable nicotine liquid. The rate is $0.05 per milliliter of consumable nicotine liquid solution - a volume-based excise, not a percentage of price.

The practical effect is that tax exposure scales with milliliters shipped, not with wholesale cost. A 30 mL unit carries $1.50 in state excise whether it sells at $8 or $18. A 100 mL unit carries $5.00. Per the SC Daily Gazette, the rate is in line with those already set in North Carolina and Georgia, and state fiscal analysts projected roughly $14 million in annual revenue directed toward Medicaid.

Who Owes the Tax and Who Needs a License

SCDOR places the filing and payment responsibility on the first business that purchases or sells nicotine vapor products in South Carolina. That definition deliberately reaches up the supply chain: retailers, wholesalers, distributors and manufacturers can all land in scope depending on how product enters the state.

A separate license - free, but mandatory before engaging in the sale of vapor products in the state - is required for in-state wholesalers, distributors and manufacturers first receiving untaxed products in South Carolina; out-of-state wholesalers, distributors and manufacturers selling and distributing to South Carolina retailers or consumers; retailers purchasing untaxed products from an out-of-state distributor or manufacturer; retailers manufacturing and mixing e-liquid products, such as house juice, that contain consumable nicotine liquid; and vending machine operators purchasing and selling untaxed products.

Two categories deserve particular attention from brands. First, out-of-state sellers are explicitly named - shipping into South Carolina from another state does not sidestep the requirement. Second, retailers who mix their own house e-liquid are treated as in-scope, which folds small-batch producers into the same regime as national distributors.

The Compliance Calendar: Sept. 24, Oct. 1, Nov. 20

Registration runs through MyDORWAY, the state's tax portal, and opens September 24, 2026. Businesses already managing accounts there can log in, open the More tab and select Business Tax Application. Everyone else starts at dor.sc.gov/register. Companies that already hold a Cigarette Tax Stamps or Other Tobacco Products account will be issued a new license including the Nicotine Vapor Products Tax account once they register.

Collection begins October 1. Returns are monthly, due by the 20th of the following month, and SCDOR requires a filing every month even when there is no activity to report. Filing and payment must be handled electronically. The first return, covering October 2026, is due November 20.

The same law also created a tax on cigarettes for heating - heat-not-burn products - and licensed South Carolina distributors can begin ordering HNB tax stamps on MyDORWAY starting September 24 as well.

Why Volume-Based Taxes Reshape Product Strategy

Per-milliliter excise is now the dominant model in US state vape taxation, and it changes the arithmetic of a product line in ways a percentage-of-price tax does not. Under a volume tax, every milliliter costs the same regardless of nicotine strength, flavor complexity or ingredient cost. Premium formulations absorb the tax more comfortably than commodity product, because the excise is a smaller share of the retail price.

It also raises the cost of inaccurate fill volumes. If a brand's nominal 60 mL bottle is consistently filled to 62 mL, that overfill is taxable volume the company is paying on and not selling. Across a large run, fill tolerance becomes a line item rather than a rounding error.

And because returns are volume-based and monthly, the documentation burden shifts onto production records. Brands need to know, per SKU and per batch, exactly how many milliliters of nicotine-containing liquid were produced and shipped into each taxing state. Where that data lives in a spreadsheet reconstructed after the fact, audits get expensive.

What Brands and Distributors Should Do This Week

Determine whether your business is the first purchaser or seller of nicotine vapor products in South Carolina, since that is the test SCDOR applies. If you ship into the state from elsewhere, assume you are in scope until you have confirmed otherwise. Register on MyDORWAY as soon as the application opens on September 24 rather than during the first week of collection.

Then confirm you can report milliliters by SKU for any given month. That means nominal fill volume per unit, units shipped, and a batch record that ties the two together. SCDOR lists a Tobacco Tax contact line and email for businesses unsure whether the tax applies to them; state guidance is the authoritative source, and this post is not legal or tax advice.

Manufacturing Built for Volume-Based Compliance

South Carolina is one more state where a brand's tax exposure is a direct function of how precisely it manufactures and how well it documents. Nova Manufacturing is a US-based e-liquid contract manufacturer built around that reality: standardized formulations that hold consistent across production runs, controlled fill volumes, and batch documentation that records exactly what was produced, at what strength, in what quantity - the records that state excise filings and audits actually require.

We produce to GMP-quality standards for vape brands, private-label programs and distributors who need their compliance paperwork to match their inventory without a reconstruction exercise every month. If you are evaluating how your current production setup will hold up as per-milliliter taxes spread across more states, get in touch with Nova Manufacturing to talk through formulation, fill accuracy and batch records for your line.
