FDA Signals New PMTA Rulemaking: What Brands Should Do

The FDA has said it intends to evaluate changes to the premarket tobacco product application (PMTA) framework, including through new rulemaking to replace the current one. For vape brands, distributors, and wholesale buyers who have spent years building around the 2021 PMTA process, it is a notable signal. It is also an early one: no proposed rule has been published, and the agency has not given a timeline.

What the FDA Said

In a press announcement in late September 2026, the FDA said it "intends to evaluate changes to the PMTA regulatory framework, including through initiation of new rulemaking to replace the current framework." The agency pointed to three drivers: its experience administering the system since 2021, the "widespread development of an illicit and unregulated market," and the rapid introduction of new products.

The FDA also said it will continue processing PMTA submissions and issuing decisions under current law, and that any future changes would include opportunities for public input. In the same announcement, the agency acknowledged a federal lawsuit filed in the U.S. District Court for the Northern District of Texas that challenges the current regulatory framework. The FDA did not detail its position in that case.

What the Announcement Does Not Say

Just as important is what is missing. The FDA's statement does not include a draft rule, a date for starting or finishing rulemaking, or a description of specific regulatory changes. It does not mention electronic nicotine delivery systems (ENDS) by name. Brands should read it as a statement of intent, not a change in the rules that apply today.

Because the agency said it will keep deciding applications under current law, the existing PMTA requirements remain the operating framework until the FDA says otherwise through a formal process.

What Press Reports Say Could Change

Coverage of the announcement from outlets including Reason and Nicotine Insider describes the administration as looking at ways to speed up and simplify authorization. Reported ideas include simplifying scientific study requirements, shortening review times, and reducing redundancy when applications cover multiple related product variations. Reason also reports that an HHS spokeswoman said the administration aims to keep nicotine out of the hands of kids while providing safer alternatives for adults who want to quit smoking cigarettes.

These items come from press reporting on the administration's thinking, not from the FDA's published statement, and none of them has been formalized. How any new framework would treat flavored products, product variations, or manufacturing documentation is not yet known.

How Brands and Distributors Can Prepare Now

Rulemaking of this kind typically moves through public notice and comment, which gives industry a chance to weigh in. The practical steps for businesses are straightforward. Watch the Federal Register and FDA's Center for Tobacco Products announcements for a proposed rule and comment period. Keep formulation records, ingredient specifications, and batch documentation current, since any application framework, old or new, will lean on well-documented products. And avoid building a launch plan on assumptions about what a future rule might allow.

Distributors and wholesale buyers should keep sourcing decisions tied to products and suppliers that can document what is in each bottle and how it was made. Regulatory change tends to reward the operations that already have their paperwork in order. As always, this is general industry information and not legal advice; brands with specific PMTA questions should consult regulatory counsel.
