A report that the administration plans to overhaul how FDA reviews new e-cigarettes and nicotine pouches surfaced on September 24. The report is unconfirmed by FDA, and details remain thin. Here is what has been reported, what has not, and what e-liquid brands can sensibly do while they wait.

What was reported

The Wall Street Journal reported that the Trump administration is preparing changes to the premarket tobacco application (PMTA) review process, potentially speeding authorization for products such as flavored vapes and nicotine pouches. Reuters, as summarized by Tobacco Reporter, said it could not independently verify the report. The reported plan would revisit requirements that FDA put in place in 2021.

What has not been confirmed

FDA has not published a proposal, guidance or press release describing any change. An HHS spokesperson, quoted by Reuters, said the administration is committed to keeping nicotine out of the hands of kids, getting counterfeit vaping products off the streets and providing safer alternatives for adults who want to quit smoking cigarettes. That statement does not confirm the reported PMTA changes. Specific timelines, scientific standards and product categories have not been made public.

Industry and public health reaction

Some smaller companies, including Charlie's Holdings and Haypp Group USA, welcomed the potential changes, citing the cost of the current PMTA process for smaller businesses and the growth of illicit products. Public health advocates have warned that loosening requirements could set back progress on youth nicotine use.

What this means for e-liquid brands and distributors

Until FDA acts formally, current requirements stand. Brands with pending applications, or planning them, should keep their documentation current: standardized formulations, batch records and consistent ingredient sourcing are the foundation of any application regardless of how the review standard evolves. Distributors should continue to source only from manufacturers that can document compliance and traceability.
